Your statutory customer rights are not affected.
Seller means Firecrest Communications Limited. (registered in England, company registration no. 4589581) trading as Jardé. The company's web site is www.jarde.co.uk. Customer means the person or company to whom this document is addressed.
International Customer shall mean, Customer from outside the United Kingdom.
These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as Jardé, to the buyer hereafter referred as the Customer.
All prices are quoted in Great British Pounds Sterling and are inclusive of VAT (if applicable) unless otherwise specified.
3.1 Payments must be made in Great British Pounds Sterling only, unless otherwise specified, and by one of the following payment methods.
3.2 Major credit and debit cards as listed: Credit Cards - Mastercard and Visa. Debit Cards - Visa Debit, Visa Electron, MasterCard Debit, Maestro and Solo.
4. Passing of Property
Jardé shall retain the property of the goods until full payment has been made by the customer and has been received.
5. Passing of Risk
The risk in the goods shall pass to the Customer on delivery, as defined in clause 8 below.
Any date or period for delivery shall be considered as indicative only, although it is our policy to try to despatch all orders within 1 – 4 working days. Jardé cannot be held responsible for delays in the delivery caused by the supplier, or any other third party.
All orders are delivered using Royal Mail or UPS courier services, unless otherwise specified. All products are shipped for next day delivery and may require a signature on delivery. Jardé may fluctuate delivery prices in proportion with their costs for shipping.
8. Passing of Risk
Where goods have been received damaged, a refund/exchange application will only be acknowledged if the goods are returned to Jardé's trading address together with their original packaging within 7 days of the customer receiving their order .
Where the goods are signed for, the customer bares the risk once the goods are signed for. If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods.
In the event of either of the above, Jardé will forward a claim to Royal Mail on the behalf of the customer. Before this can be processed, Jardé will issue the customer with a 'Lost Orders Form' which must be completed and returned before any claim can be pursued.
This is not a guarantee and Jardé has the right to refuse any application. Any refund/exchange given is at the discretion of the management of Jardé. Failure to give accurate information while making a claim may lead to prosecution from Royal Mail.
The Customer shall inspect the goods within a reasonable time after their receipt and shall be deemed to have accepted the goods. If the goods are faulty or damaged, the Customer shall have notified the seller that the goods are rejected within 14 days from the receipt of the goods (This does not however affect the customer’s statutory rights). If no such action has been taken, Jardé shall consider the products being as described, of satisfactory quality and fit for their purposes, and may not accept any reject at a later date.
10. Returns Procedure
We do not accept returns due to hygiene reasons, unless the goods have been damaged or Jardé delivered wrong order to customer in which the Customer is entitled to replacement. The Customer shall comply with the return procedure as defined in Customer Service page.
11.1 Cancellations are only accepted if the Customer complies with the following cancellation procedure defined in Customer Service page.
12. International Customers
Jardé is a UK based organisation and currently will accept orders for delivery within and outside of the United Kingdom. Those orders must be paid for in GB Pounds sterling.
These terms and conditions are governed and shall be interpreted in accordance with English Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.
